Terms of Service
Please read these terms carefully before using this service. By clicking Register, Log In, or Place Order, you confirm that you have read and agree to be bound by these terms (unless a separate agreement applies).
1. General Provisions & Scope
1.1 These terms are entered into between you and Nuvcloud ("we" or "Platform") regarding your use of the cloud Mac computing resources and related services ("Service") provided by this Platform.
1.2 The Service is intended for individuals, legal entities, or other organizations with full legal capacity. If you use the Service on behalf of a company, you represent that you have the necessary authority.
1.3 Privacy Policysupplements these terms and governs the handling of personal information. Please also read thePrivacy Policy.
2. Service Description & Orders
2.1 The Service includes but is not limited to: providing a remote Mac environment, network access, console display, and provisioning/support workflows associated with your order, according to the selected configuration and billing cycle. Specific specs are governed by theplan details page, pricing page, and order confirmation.
2.2 You can select a model, billing cycle, data center, and value-added services on the pricing page and submit an order. If you orderwithout logging in, you must complete account binding or registration in a subsequent step; otherwise, delivery and support may be affected.
2.3 After successful payment, the system will proceed with resource configuration and provisioning per its internal workflow (including tickets). Provisioning time is subject to stock, region, and review factors,and does not constitute a fixed time commitmentunless otherwise specified in the order or a written agreement.
3. Pricing, Payment & Billing Cycle
3.1 Prices are as displayed at the time of ordering. Currency and tax details are governed by the payment channel and applicable local regulations.
3.2 DailyBilling is generally a one-time purchase; it does not auto-renew upon expiry.Monthly / Quarterlyand similar subscription-type billing mayauto-renewand charge your linked payment method if not actively cancelled before expiry. Refer to the subscription page and payment confirmation for details.
3.3 You must complete payment through the designated channels (e.g., Rainbow YPay). Any fees or exchange rate differences resulting from third-party payment processors are handled per the processor's rules.
4. Account & Security
4.1 You are responsible for safeguarding your account, password, verification codes, and API keys. Any loss resulting from inadequate protection is your responsibility.
4.2 If you detect unauthorized access, notify us immediately and change your credentials. We may restrict logins or freeze orders if we have reasonable suspicion of a security risk.
4.3 You may reset your password through theReset Passwordflow (email verification code) in the login modal, or via Change Password in the Dashboard. The password must be8–16characters long and consist of printablevisible characters(letters, numbers, and common symbols are all accepted; no Chinese characters, spaces, or emoji). The exact validation rules are shown in the app.
5. Acceptable Use & Prohibited Conduct
5.1 You agree to use the Service only as permitted by applicable law, and not to use it for, including but not limited to:
- Conduct that violates the laws and regulations of mainland China, the location of the Service, or your own jurisdiction;
- Infringement of third-party intellectual property rights, privacy, reputation, or trade secrets;
- Distributing malware, conducting cyberattacks, or performing unauthorized penetration testing;
- Sending spam, fraudulent messages, or engaging in other harassing behavior;
- Mining, traffic manipulation, or other resource abuse that may compromise fairness or platform stability (unless expressly authorized by us in writing).
5.2 We reserve the right to issue warnings, throttle bandwidth, suspend instances, terminate service, cooperate with regulators, and pursue legal remedies in response to prohibited conduct.
6. Data, Network & IP
6.1 Data stored and processed on your instance isyour sole responsibility to back up and keep compliant. Our liability for data loss caused by force majeure, maintenance, or your own actions is limited to the extent permitted by law.
6.2 Network quality, latency, and availability are subject to multiple factors including public internet and carriers. We make no guarantees regarding experience in specific business scenarios unless separately agreed in an SLA.
6.3 IP addresses are assigned per the selected data center;dedicated IPv4such descriptions are governed by the product specification. You must not use resources for sending illegal content or in ways that cause IPs to be blacklisted.
7. Service Changes, Interruptions & Termination
7.1 We may modify, suspend, or terminate portions of the Service for upgrades, maintenance, compliance, or business reasons. We will make reasonable efforts to notify you via website announcements, email, or console notices.
7.2 You may cancel or stop using the Service at any time per the applicable rules. Whether unused prepaid amounts are refundable is governed by Section 8 and any special order terms.
7.3 In cases of material breach or outstanding payments, we may suspend or terminate the Service and reserve the right to seek recourse.
8. Refunds, Disclaimers & Liability
8.1 Refund conditions, procedures, and timelines are governed bythese supplementary terms, the order page, and customer support/ticket responses. Certain promotional or custom orders may be marked non-refundable.
8.2 To the maximum extent permitted by law, we are not liable forindirect losses, lost profits, data loss, or business interruptionunless caused by our willful misconduct or gross negligence and mandatory law provides otherwise.
8.3 We are not liable (to the extent permitted by law) for service issues caused by force majeure, third-party service failures, your own actions, or circumstances beyond our reasonable control.
9. Policy Updates & Notifications
9.1 We may revise these terms. Material changes will be announced via website posting, pop-up, or email. Continued use of the Service after changes take effect constitutes your acceptance.
9.2 If you do not agree to the revisions, you should stop using the Service and settle any outstanding charges.
10. Governing Law & Disputes
10.1 The formation, validity, and interpretation of these terms are governed bythe laws of mainland China.
10.2 Disputes arising from these terms shall be resolved through negotiation. If negotiation fails, either party may bring the matter beforethe competent People's Court at the defendant's domicilefor litigation.
